TO ALL JDS BUYERS READ PAGE (3) NOTICE TO BUYERS


in the event escrow is waived above, the BUYER(S) hereby acknowledge and agree that total deposit may,at the sole discretion of the SELLER, be used for costs of development of the project in which the TOWNHOUSE SUBJECT TO THE CONTRACT IS LOCATED, including without limitation for construction, design,engineering,marketing, sales expenses and real estate commission advances.

so as nothing has been built, REASON, NO PERMIT , NO DEVELOPMENT, NO CONSTRUCTION, NO DESIGN THAT HAS BEEN APROVED BY POLK COUNTY AFTER TWO DESIGN ATEMPTS, NO ENGINEERING, so where has all jds deposits gone as jds is a parcel
on its own, that leaves real estate commission that could be between 14%-20% ??? and if units are not closed on deposits must be returned. so why did some jds people get there deposits back and not all of us, jds was never talked about in malcolm wrights road shows,(please say if you know different from me) i say and still say jds was never to be built, so that leaves TRI-COUNTY VENTURES AND NOT JDS CONTRACTS is it then possible our money was put into TDS and who knows where thats gone BUT rest assure we will find out.when alg file for bankruptcy's of jds it will be interesting to read the file on finance. DEPOSITS HAVE NOT GONE ON CONSTRUCTION, DESIGN, ENGINNERING, THE CONTRACT IS VERY CLEAVERLY WORDED YOUR MONEY HAS GONE ON MARKING, SALES EXPENSES, STRANGELY!!! but to no surprise to me, malcolm/maddox has just put it in their pockets. ps, i forgot and the realtor.

In September 2005 my partner and myself wanted a holiday home in Florida. We came across a Florida property road show hosted by the famous Realtor. It was here that we were introduced to a development called Tierra del Sol (TDS). We were told that TDS was sold out and we were offered a unit in Jardines del Sol (JDS). It was a bit further away from the water park and other amenities in TDS but the lower purchase price reflected this ($430K). We were told that TDS and JDS were the same resort and all managed by Sonesta (so far so good!).

We have since found out that TDS, JDS and Bella Citta are not all one resort but all separate parcels but all with the same parent company American Leisure Group. Although JDS and Bella Citta would be given access to the TDS amenities, the reality is is that we have invested in a unit without a waterpark, clubhouse etc; and back in 2005 a comparable unit on another development would have been in the region of $200K.

I have also found out from a reliable source that JDS has no building permits, no water permits and planning was declined by Polk County on the basis that they (Polk County) wanted much more retail space along I27 where JDS was planned to be built. In addition, Polk County refused the building of 'back-to-back' units on the grounds that the fire department were not happy with the construction. The TDS units are of a back-to-back construction and permission to build was granted but building regulations have been changed in the last 5yrs and this type of construction is no longer allowed. Malcolm submitted an amended plan with less JDS units and more retail space but to no avail. Therefore, as we speak, JDS (and as far as I know Bella Citta) do not have the necessary planning or permits to go ahead. This may explain why JDS investors were asked to reload to TDS.

Another observation for consideration is, JDS contracts have the seller as 'Tri-County Road Ventures' whereas the TDS contracts have the seller as TDS. Does anyone know why this would be and what the implications are?

The above comments are based on information I have received which is to the best of my knowledge accurate and can hopefully be verified in the near future.

If anyone else has information they think can help in regard to JDS, please post.

Hi,

It was established at the meeting last Saturday that JDS are a separate entitity/development to TDS, Bella Citta and The Preserves, and as such, are still currently a going concern. However, Simon Reynolds has written to say that JDS will file for Chapter 11 shortly. I was asked at the meeting to speak to a lawyer to see if there is any way that JDS owners could be listed as secured creditors to gain an advantage. The lawyer's opinion is that to do this we would have to sue JDS prior to Chapter 11 and in view of the limited time and, more importantly, we as owners do not have a lien over the land, he would not recommend it as it would prove too costly and would almost certainly not be successful.

Therefore, it looks like JDS owners will have to sit it out, wait for Chapter 11 and then proceed along with TDS.

If anyone has more information re JDS please post.
